Article 2 — Scope and Purpose

These Terms and Conditions of Sale govern the contractual relationship between Hayoss (the "Seller") and any consumer (the "Customer") making a purchase on hayoss.com. By confirming an order, the Customer acknowledges having read and accepted these Terms without reservation.

Article 3 — Products

Hayoss sells cosmetic products (skincare, makeup, fragrances, hair care, beauty accessories) sourced from international suppliers and shipped directly from the supplier's warehouse (dropshipping model). Products comply with EU Regulation (EC) No 1223/2009 on cosmetic products.

Cosmetic warning

These are cosmetics, not medicines. In case of allergic reaction or skin irritation, discontinue use immediately and consult a doctor. Read the INCI ingredient list carefully before use.

Article 4 — Pricing and Payment

Prices are displayed in Euros (EUR) inclusive of all taxes. Shipping fees are shown separately and confirmed before checkout. Accepted payment methods: Visa, Mastercard, American Express (via Stripe) and HYP/YaadPay (Israel). Card data is managed exclusively by Stripe (PCI-DSS compliant); Hayoss never stores card numbers.

Article 5 — Order Process

After selecting your products, entering your delivery address, choosing a shipping method, and completing payment, you will receive an email order confirmation. The order is only finalised upon receipt of this confirmation email and payment validation.

Article 6 — Delivery

Products are shipped from international warehouses (mainly Asia) directly by the supplier (dropshipping). A tracking number is sent by email once dispatched.

Article 7 — Right of Withdrawal

Under the Consumer Rights Directive (2011/83/EU) and French consumer law (art. L221-18 Code de la consommation), you have 14 calendar days from receipt of your order to exercise your right of withdrawal without justification or penalty.

Exception — Cosmetic products (art. L221-28)

The right of withdrawal cannot be exercised for cosmetic products that have been unsealed or opened after delivery, for hygiene and health protection reasons. Returned products must be in original packaging, unopened and unused.

Article 8 — Returns and Refunds

For valid withdrawals or defective/non-conforming products, the Customer must return the product within 14 days of the withdrawal notice. Return shipping is at the Customer's expense (unless the product is defective). Refunds are issued within 14 calendar days by the same payment method used.

Article 9 — Legal Warranties

  • Legal warranty of conformity2 years from delivery (art. L217-4+ Consumer Code).

Article 11 — Disputes and Mediation

In case of dispute, please first contact our customer service at contact@hayoss.com. We undertake to respond within 48 business hours. If no amicable resolution is reached, you may refer the matter to a consumer mediator free of charge.

Article 12 — Force Majeure

Hayoss shall not be liable for non-performance caused by force majeure (natural disaster, pandemic, carrier strike, customs blockage, third-party provider failure, etc.) as defined by art. 1218 of the French Civil Code.

Article 13 — Applicable Law and Jurisdiction

These Terms are governed by French law, without prejudice to the mandatory consumer protection rules applicable in the Customer's country of residence (EU Directive 2011/83/EU). In case of unresolved dispute, French courts shall have exclusive jurisdiction.
